What’s Next, Now That Texas Injunction on Immigration Upheld

A temporary hold was issued by a Brownsville Texas Judge back in February, after 26 states filed a lawsuit alleging Obama’s action was unconstitutional. The Justice Department asked for a stay, but the ruling by the Court of Appeals for the Fifth Circuit  Tuesday denied that request.

Charles ‘Rocky’ Rhodes, a professor at the South Texas College of Law in Houston, joins the Texas Standard to discuss what’s next.

On what the next steps might be: 

“I think right now the Department of Justice …is probably going to seek emergency relief from the supreme court of the United States. And the supreme court can issue emergency relief even while the case is still pending in the lower courts. This is not a final decision on the program, this is just a refusal to let it go into effect.”

On what happens after President Obama is out of office: 

“This was always essentially President Obama’s baby, if you will, the next president was always going to be free to change, modify, or eliminate this program…this is going to be a real driving factor in the 2016 presidential election.”
