Texas Senator Ted Cruz says that a court order prevents the government from allowing parents and children to stay together once parents are placed in jail. Is that a fact?

This statement comes from an interview between Cruz and KERA’s “Think” about family separations at the U.S.-Mexico border. Cruz claimed that when Americans are arrested, they too are separated from their families because a court order stands in the way of keeping them together.
